Job Applicant Notice

1. What Is the Purpose of This Document?

The purpose of This Document is to inform you as to because you are applying to work with Alshaya ( Alshaya will be referred herein as (“We” or “Us”) (whether as an employee, worker, consultant, or contractor), how and why your personal data provided will be used, namely for the purposes of the recruitment exercise, as well as how long it will usually be retained for.
Alshaya is committed to protecting the privacy and security of your personal information. We are considered "data controller" and can be contacted at hrsupport@alshaya.com This means that we are responsible for deciding how we hold and use personal information about you. We have appointed a Data Protection Officer (“DPO”) who is responsible for overseeing questions in relation to this privacy notice. The DPO will monitor our compliance with legal requirements and with this privacy notice. Our Data Protection Officer can be contacted directly at: dpo@alshaya.com

2. Data Protection Principles

We will comply with data protection law and principles of the relevant country in which your personal data is provided, which means that your data will be:

  • Used lawfully, fairly and in a transparent way.

  • Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.

  • Relevant to the purposes we have told you about and limited only to those purposes.

  • Accurate and kept up to date.

  • Kept only as long as necessary for the purposes we have told you about.

  • Kept securely.

3. The Kind of Information We Hold About You

In connection with your application to work with us, We will collect, store, and use the following categories of personal information about you:

  • The information you provide to us through our corporate website within our internal careers section.

  • The information you provide to us in your curriculum vitae (solicited or unsolicited) and covering letter and any other submission requested or provided.

  • The information you have provided including name; title; address; telephone number; personal email address; phone; employment history; professional achievements and qualifications.

  • The application forms; results of post-offer; results of background investigations, related correspondence; certificates of good conduct, interview notes; assessment(s) or skills and behavior assessment test results and references.

We reserve the right to make an offer of employment subject to the interview due to be held, your previous professional experience, the skills, behavior and fit-for-work test results, your non-criminal certificate (if applicable) and references provided.

We never collect, store and use racial or ethnic origins, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, data concerning health or data concerning a natural person’s sex life or sexual orientation from applicants in any stage of your interview process unless there is a legislation that complies us to do so after informing you of the referred legislation.

3. How is your Personal Data Collected?

We collect personal information about candidates from the following sources:

  • You, the candidate.

  • Your named referees, from whom we collect the following categories of data whether by email or phone call to assess the following non subjective and measurable parameters: Position formerly Held, Reporting Authority and Length of Service in your previous companies.

4. How will we use the Personal Information About You?
We will use the personal information we collect about you to:

  • Establish a relationship between Alshaya and a potential employee.

  • Process applications for employment.

  • Carry out background and reference checks once a decision has been made by us.

  • Communicate in any stage with you about the recruitment process.

  • For such other purposes as permitted by applicable law or with an informed and explicit consent.

Having received your information through our portal, your CV and covering letter or your application form and or the recruitment agency (if any) that provided it to us, after informing you on the hiring process and how we manage your data, we will then process that information to decide whether you meet the basic requirements to be shortlisted for the role or not. If you do, we will decide whether your application is strong enough to invite you for an interview. If we decide to call you for an online or offline interview, we will use the information you provide to us at the interview to decide whether to offer you the role. If we decide to offer you the role, we will then take up references and carry out a skills and behavior assessment test before confirming your appointment.

 

5. If You Fail to Provide Personal Information

If you fail to provide information when requested, which is necessary for us to consider your application (such as evidence of qualifications or work history), we will not be able to process your application successfully.

6. Information About Backgrounds

We envisage that we will process and store information about background investigations and certificates of good conduct issued by policing authorities and due diligence of all candidates. Once a decision has been made regarding interest in hiring an applicant any offer will be made contingent upon satisfactory completion of reference checks and criminal background checks.
We will only process information about criminal records, convictions, and offences where we have obtained your explicit consent, where necessary for the purposes of performing or exercising our or your obligations or rights under applicable laws and regulations and where it is necessary for the prevention and detection of an unlawful act or for reasons of substantial public interest.
Where we are processing personal information based on your consent, you have the right to withdraw that consent at any time where there is no other legal basis for the processing, by contacting us at hrsupport@alshaya.com.

7. Automated Decision-Making

You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making.
 

8. Why Might You Share My Personal Information with Third Parties?

We will only share your personal information with selected third parties – e.g. Manpower – for the purposes of payroll processing once you become Alshaya consultant, contractor or employee depending on where you are due to be based. All the selected partners have been required to take appropriate security measures to protect your personal information in line with our policies. We do not allow any third-party practice to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.
Candidates are free to share their personal information with external providers such as Page Up, LinkedIn, Bayt, Facebook Page where we place some of our available roles from time to time under their own solely risk.

9. Data Security

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors, consultants and other third parties who have a business need-to-know. They will only process your personal information on our instructions, and they are subject to a duty of confidentiality. 11. How Long will you Use my Personal Data for?

To show, in the event of a legal claim, that we have not discriminated against candidates on prohibited grounds and that we have conducted the recruitment exercise in a fair and transparent way.

12. Candidates Talent Pool

To create a Talent Pool of potential candidates, Alshaya shall ask to keep your personal data on file in case there are future employment opportunities with us for which you may be suited for another 12 months. We will ask for your consent before Alshaya keeps your data for this purpose and you are free to withdraw your consent at any time by contacting us at deletemyprofile@alshaya.com


After this period, we will securely destroy your personal information in accordance with our Alshaya Personal Data Retention Policy.

13. Your Rights in Connection with Personal Information available to us

Under certain circumstances you have the right to:

Request access to your personal information (commonly known as a "data subject access request") that we hold.

This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

Request correction of the personal information that we hold about you on where you will be liable for any loss or damage caused to the platform or to any third party by reporting erroneous, inaccurate, or incomplete information in the registration form.

This enables you to have any incomplete or inaccurate information we hold about you corrected.

Request erasure of your personal information.

This enables you to ask us to delete or remove personal information where there is not a sufficient reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).

Object to the processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.

Request the restriction of processing of your personal information.
This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.

Request the transfer of your personal information to another party.
If you want to review, verify, correct or request erasure of your personal information after 12 months from the date of decision not to hire you, object to the processing of your personal data, or request that we transfer a copy of your personal information to another party, please contact us on hrsupport@alshaya.com.

Right To Withdraw Consent

When you apply for a role, you provide consent to us processing your personal information for the purposes of the recruitment exercise. You have the right to withdraw your consent for processing for that purpose at any time. To withdraw your consent, please contact the person who interviewed you, if applicable, by stating her or his name and the role that you applied for at deletemyprofile@alshaya.com Once we have received notification that you have withdrawn your consent, we will no longer process your application and, subject to our retention policy, we will dispose of your personal data securely.

Right To Lodge a Complaint

You have the right to make a complaint at any time to the data protection authority in the state of your habitual residence, place of work, or place of an alleged infringement of the data protection regulation once you approached us at dpo@alshaya.com with no satisfactory results.

Changes to this Document

We may amend the information contained in this document when we consider this appropriate. Should we do so, we will notify you by various procedures through the Platform (for example, through a banner or a pop-up ). In any case, we suggest you to review this Document from time to time in case minor changes are made or we make any interactive improvement, taking the opportunity that you will always find it as a permanent point of information on our Website.
